Constitutional and Legal Regulation of State and Private Property
Abstract
The article analyzes the constitutional mechanisms of regulation of public and private property rights, based on the constitutional provision on the recognition and equal protection of different forms of ownership in the Constitution of Kazakhstan. Despite the deep scientific development of the constitutional-legal concept of property, some issues, one of which is the ratio of public and private property rights from the perspective of constitutional law, are not fully resolved. The purpose of the study reflected in this work is to analyze the constitutional provisions of property regulation related to the balance of interests of subjects of constitutional legal relations. The work identifies the problems and contradictions associated with the consolidation of this institution in the Constitution of Kazakhstan; a comparison with the constitutions of other countries and the features of international legal regulation of this institution is conducted. The authors highlight the main existing international legal regulations and identify trends in the regulation of property rights under international law. The provisions advocated by the authors, conclusions, and proposals on the application of international experience can be used in the preparation of amendments to the current legislation of Kazakhstan on the regulation of property relations.
